1. Definitions

The following terms in these General Terms and Conditions (the ‘Terms’) mean:

* ‘Event’: the event or tour at which an activity of the tourist or organization with its participants takes place, including an excursion, a museum visit, a concert, an event or an other activity organized by Talk of the Town Tours (TTT);

* ‘Location’: the place(s) of the tour;

* ‘Organizer’: the party responsible for the production of and/or organization of the tour;

* ‘Agreement’, the agreement between TTT and the consumer or company for the sale of the tour and the

delivery of tickets;

* ‘Ticket’ or ‘e-ticket’: proof of access to a tour.

2. Applicability

2.1 These General Terms and Conditions and the booking and ordering conditions of TTT apply to all offers, orders

and agreements of TTT.

2.2 In addition, the General Terms and Conditions of the organizer and the General Terms and Conditions of the

party responsible for the locations or part of the tour that’s integrated in the TTT order will also apply. In case

of any conflict between these organizations’ documents and these General Terms and Conditions, the provisions

in the agreement and in these General Terms and Conditions will prevail.

2.3 By accepting orders of TTT, the consumer or company expressly accepts the applicability of these

General Terms and Conditions.

2.4 Any deviations from these Terms and Conditions are only allowed by mutual written consent of the parties. In

that case the other provisions will remain undiminished in force.

2.5 TTT may amend these Terms. TTT shall announce any such amendments at least one week before the

amendments take effect. The consumer or company may terminate the agreement as per the date on which the

amended conditions will take effect, if the consumer or company does not wish to accept such amended


3. Prices/offers

3.1 All offers made by TTT are without obligation. TTT expressly reserves the right to change the prices if

necessary. This is in particular necessary as a result of statutory or other regulations.

3.2 All prices are indicated in euros, including VAT.

3.3 TTT can apply in certain cases promotional prices or give away special coupons. These offers are valid during a

specific period as long as stocks last. Before or after this specific period no entitlement to these prices may be


3.4 TTT cannot be held to any price indications that are clearly incorrect. No rights may be derived from incorrect

price information, for instance as a result of obvious typesetting or printing errors.

4. Cancellations and returns

4.1 An organizer is entitled to cancel or change the date of an event or tour. In that case TTT shall attempt to provide

a suitable solution. If an event or tour is cancelled or postponed, TTT will do its utmost to inform the consumer

of company as soon as possible. However, TTT cannot guarantee that the consumer or company will be informed

before the start of the event or tour. TTT cannot be held liable for any costs incurred.

4.2 Before confirming the booking, the consumer or company always has to check carefully the booked

tickets. TTT is not obliged to refund or exchange tickets once they have been sold. If a ticket is damaged to such

an extent that its authenticity can no longer be verified, the consumer or company can contact TTT. The

consumer or company will be informed of further actions to be taken.

5. Payments

TTT accepts a number of different payment methods. Payments in euros are processed among others

via iDeal, PayPal and by credit card. Consumer or company will receive confirmation of the definitive

booking after the payment has been approved.

6. Delivery

6.1 Tickets or e-tickets will be delivered or confirmed by e-mail.

6.2 The delivery times specified by TTT are for indication purposes only. Failure to meet any delivery deadline will

not entitle you to damage compensation, nor will it entitle you to cancel the order or dissolve the agreement, unless

such failure to meet the delivery deadline is so severe that it cannot reasonably be demanded of you to abide by the

agreement. In that case, you will be entitled to cancel the order or dissolve the agreement and TTT will refund the

amount paid for the tour.

7. Retention of title

7.1 The ownership of the tickets delivered will only transfer to you if you have met all your obligations to TTT.

The risks relating to the tickets will be transferred to you at the time of delivery.

8. Complaints and liability

8.1 Consumer or company are obliged to check the order on delivery to ensure that the tickets are in line with the

agreement. If not, consumer or company must inform TTT in writing as soon as possible, and not later than 3 days

after delivery.

8.2 If it has been demonstrated that the tickets are not in line with the agreement, TTT may choose to replace the

tickets or to refund the amount paid.

9. Electronic communication

9.1 TTT is not liable for any misunderstandings, distortions, delays or incorrect transmission of data and

messages as a result of the use of the internet or any other communication medium between the consumer or

company and TTT.

10. Force majeure

10.1 Without prejudice to the other rights to which it may be entitled, in case of force majeure, TTT is entitled, at its

own choice, to suspend implementation of the order or to dissolve the agreement by informing consumer or

company in writing. In this case TTT cannot be held liable to any damage compensation.

10.2 Force majeure is deemed to mean any circumstance that is beyond TTT’s control and for which TTT cannot be

blamed, nor deemed to be responsible according to the law. TTT can suspend, if necessary, contractual

obligations during the period of force majeure.

11. Special provisions, liability

11.1. The buyer of a ticket supplied by TTT must behave as a good and orderly visitor and must abide by the

instructions issued to him or her by or on behalf of the organizer of the tour to be visited as well as by the

competent authorities.

11.2 TTT will not be liable for any refusal by the organizer of a tour or by the public authorities to admit the buyer of

a ticket supplied by TTT to a tour as a result of actions and/or negligence on the part of the buyer.

11.3 The buyer of a ticket or the participants of the tour booked by a company attends a tour at his or her own

risk. TTT will not be liable for any damage incurred during the journey to or from the tour, or while attending the tour

or event. TTT is not responsible for damage to items or for any personal injury or accident. TTT is also not liable for

the loss and/or damage to any items brought onto the tour by the consumer or participants from the company

that booked the tour.

11.4 The buyer of a ticket supplied by TTT must be informed of the instructions issued by or on behalf of the

organizer of the tour or the competent authorities relating to it, including any changes concerning the tour, such as

starting time, etc. TTT has no obligation to provide the buyer of a ticket with further information in this regard.

11.5 In case of using a vessel, bike, bus or any other object during the tour, the consumer company is

responsible for any damage to and/or loss of the vessel, bike, bus or any other object that is not covered by

insurance and which arises during the time that he or she has possession of the vessel, bike, bus or other object.

The consumer or company is not responsible if they can demonstrate that the damage and/or loss cannot be

attributed to them or one of their party.

12. Other provisions

If one or more of the provisions in these Terms and Conditions or any other agreement with TTT are in conflict

with any applicable legal regulation, the provision in question will lapse and be replaced by a new comparable

stipulation admissible by law to be determined by TTT. The law of the Netherlands applies to all agreements

entered into with or concluded by TTT. Any disputes arising -directly or indirectly- from the agreements

between costumer or company and TTT will be exclusively settled by the Court of Amsterdam.
